AB 1634.... and a half?

Well... this seems like a bummer. But after reading the new bill... it is NOT all that bad. Right???

At least the words spay and neuter remained in the bill.... right???

Here is the gist of the new bill.

The new bill targets only dogs and cats who are the subject of repeated complaints to animal control or repeated shelter impoundments.<< It relies heavily on Animal Control. And they are already overburdened.

I can see animal people filing complaints on those known to them to be breeding or at least not spaying and neutering and here is the million dollar question... WILL ANIMAL CONTROL BE ABLE TO KEEP UP ALL THE COMPLAINTS??? Is it able to handle all the complaints it has now?

In my opinion what this bill does is put the responsibility BACK on Animal Control instead of where it belongs, with the pet owner.

Think from Joe Publics POV. You hear a bill passes where it is manditory to spay or neuter your pet. What do you do? Those people who have been just putting off spaying or neutering will get it done. Those who don't care, do not get it addressed until there is a complaint. But there would be some percentage (those putting it off) who would get their pets fixed. Yippee!

Now, from Joe Publics POV with the new bill. Joe Public hears... I don't have to get my pet fixed until there is a complaint. So, Joe Public A. who is putting it off, continues to put it off, because his pet is good and there are and will be no complaints. But one day critter jumps the fence and waalaa babies are made. Joe Public A. sells or gives them to friends and we have what we have now... OVERPOPULATION, why??? Becuase ALL of Joe Public A's friends are good with their pets and there are no complaints but oopsie daisy, fence-jumper got to my dog and waalaa more babies.

Then we have Joe Public B. who doesn't care, and he still gets a complaint. And eventually gets the animal fixed, AFTER THREE COMPLAINTS. Now Joe RESCUER hears about the new bill and floods the Animal Control with complaints about known breeders. File one, two and finally three complaints and eventually the critter is fixed. But not after Animal Control has made three trips.

I have been on ride-alongs with Animal Control. It is a SLOW, TIME CONSUMING job. Meaning, you actually have to drive to each persons house to investigate the complaint. On my ride-alongs there was a stack of addresses that needed to be investigated for the day. Did we get to them all? No. Did we get to half? No? Were there interruptions? Absolutely.

When a call went out for a stray roaming in the streets in our area, we stopped what we were doing and went to chase a dog. I think we spent over an hour chasing down one dog with the aid of another Animal Control Officer, who I am certain also had a stack of reports of her own, that needed to be investigated.
And if the animal was injured, we drove directly to the vet. Then back to the stack of paperwork... uh-- oh no, not yet, another call, another stray and we were off and running.

Does this bill increase the budget for Animal Control or create a Task Force of NEW EMPLOYEES to handle these complaints? It doesn't? Rut roe.

Earlier this week Assembly Member Lloyd Levine met with Senator Gloria Negrete McLeod to discuss AB 1634. Senator Negrete McLeod chairs the Senate Local Government Committee where AB 1634 has been held since mid-2007. The Senator presented amendments that remove all the current language of the bill and replace it with new language her office developed. The committee's new analysis should be available online by Friday morning, also at www.leginfo.ca.gov and will be posted on our website as soon as available.

The coalition we have built in support of the California Healthy Pets Act is the largest many people in California politics have ever seen. I know many of you will not be happy with this proposal, and I am personally deeply disappointed that AB 1634 has been rewritten by Senator Negrete McLeod. But, please take a careful look at the new bill and the committee's analysis, and come to your own conclusion about whether it might help decrease California's pet overpopulation.

If you have comments or suggestions on the new bill, please do not send them to me; instead, please contact Assembly Member Levine's office, preferably by email at AB1634staff@gmail.com. Your email may not get a personal response, but Assembly Member Levine's office has promised that every email will be read.

Although the new language does not reflect the intent of the original bill, the fact that Senator Negrete McLeod is now willing to support any bill having to do with spay and neuter is in itself a victory. With this new language, AB 1634 will no longer be known as the California Healthy Pets Act. Our coalition will continue to work on spay and neuter legislation in the months and years to come, and I will continue to keep you informed about our ongoing efforts to combat pet overpopulation through spay and neuter. The original California Healthy Pets Act will still be available on our web site for states, counties and cities across the US to reference as they craft local ordinances and state laws.

I urge you to forward and post this email immediately, to ensure that the widest array of comments is heard before the hearing on Wednesday.

THE BILL

 Proposed Law 

Assembly Bill 1634 requires the owner of a nonspayed or
unneutered dog or cat that is the subject of a complaint to
be cited and pay a civil penalty in addition to any other
fine, fee, or penalty.

For dogs, the bill specifies these civil penalties:
First occurrence: $50.
Second occurrence for the same dog: $100.
Third occurrence for the same dog: mandatory
spaying or neutering, with the owner paying for the
procedure's cost.

For cats, the bill specifies these civil penalties:
First occurrence: $50.
Second occurrence for the same cat: mandatory
spaying or neutering, with the owner paying for the
procedure's cost.

When issuing a citation, the local animal control agency
must give the animal's owner information about the
availability of spaying and neutering services. The owner
must pay the civil penalty within 30 business days. The
local animal control agency must waive the penalty if,
within 14 days, the animal's owner presents proof from a
veterinarian that the animal was spayed or neutered.

AB 1634 defines a "complaint" as an oral or written
complaint to the local animal control agency that the dog
or cat or its owner has violated state laws relating to
dogs or cats, or any local animal control ordinance. A
"complaint" also includes the observation by an employee or
officer of a local animal control agency of behavior by a
dog or cat or its owner that violates those state laws or

local ordinances. "Complaint" does not include excessive
noise by dogs or cats, and does not include excessive dog
barking.

The bill allows local officials to adopt more restrictive
ordinances or penalties.

For the owners of impounded nonspayed or unneutered dogs,
AB 1634 increases the existing fines from $35 to $50 on the
first occurrence, from $50 to $100 on the second
occurrence, and from $100 to mandatory spaying or neutering
on the third occurrence. For the owners of impounded
nonspayed or unneutered cats, the bill increases the
existing fines from $35 to $50 on the first occurrence, and
from $50 to mandatory spaying or neutering on the second
occurrence.

AB 1634 prohibits the State Controller from releasing
payments that reimburse local agencies for the state
mandated local costs of impounding stray and abandoned
animals until the Controller determines that the local
agency has complied with the State Department of Public
Health's rabies reporting regulations. The bill declares
that this provision modifies the payment methodology, but
does not suspend the state mandated local program.
In the end I am going to SUPPORT this bill. What other options do I have?

Spirit of Indie Filmmaking

In the spirit of indie filmmaking. I really need everyone who had ever seen the film,
even the rough cut or DVD of the trailers scenes and write a letter to :

This film is truly the spirit of indie filmmaking, made entirely by donations
No other indie film at this level of filmmaking is shot like this, the shots,
the coverage, the locations,the story and structure. It is not two people
standing stock still talking. It was not shot on one location over a weekend.
The film opens in Wyoming, and was shot inside a recently abandoned animal shelter.
Using documentary footage of real shelter animals and strays.

Indie filmmaking is about what one person can do with a camera, and idea and some tenacity.

But we can get into the ten film festivals without you help.

More on Rescuers God Complex

Now let me start with saying I really have to stop this venting of rescue crap on my film website. Because really one does not have anything to do with the other. I am just grumpy and pissed.

Here is the story:

In April 07 two people emailed me about a puppy from Craigslist that needed rescue. I took on the puppy only to find out it was from a rescuer whose adoption went bad. Long LONG story short. I offered to give the dog back to the original rescue. They said to keep it. Then they wanted it back. But something was not right. The original rescue did not make any attempt to find out what happened from the people who had the dog DUMPED on them. Instead they planned on giving the dog back (UNALTERED and UNCHIPPED) to the people. My gut said LOUD and CLEAR... something is wrong do NOT give the dog back. So I did not.

Who wrote me the following email.... she wrote a few others but they were all about the same. She never wanted details she just took the side of Sylvia.

Then a few months later I got an email about Best Buddies rescue being busted for hoarding or poor conditions or something. I KNEW my gut was saying something was wrong with that rescue.

Did I hear from Dottie who called me a dog thief???? NO.

So just recently I heard that Sylvia gave the IDIOT LARODGE JOHNSON WHO IS ON A DO NOT ADOPT LIST THE SISTER DOG.... AND I just found out that the female dog is STILL NOT FIXED and she (Larodge) plans on breeding the dog with a German Shepherd. First of all it will kill the dog since she is probably about 25-30 lbs. Second SYLVIA of Best Buddies was NOT a rescuer she was selling dogs for profit or else the dog would have been fixed!!!!

Oh and that sister dog... is living in a medium crate under a kitchen table and when Larodge goes away for a weekend the dog is alone and uncared for.

DOTTIE OWES ME A HUGE APOLOGY!!!!!!

I HATE and LOATH those rescuers with such a GOD COMPLEX they can do NO WRONG.
And they do not think they need to apologize when they have CLEARLY DONE WRONG!!!

As soon as Dottie knew something with up with Sylvia she should have contacted me and APOLOGIZED!!!!

Sylvia does a good job, we work through the same Vet and if she wants her dog back , she has a right and a contract.
Again, I do not want to hear or see anything else except that Sylvia has her puppy back, no rescuer has the right to make judgment calls about another, certainly not to withhold a dog. Be glad it isn't one of mine, we have a whole staff of attorneys.

Rescuers are so judgemental its OBNOXIOUS!

Jane does some good work. She grooms a lot of shelter animals
and networks with her lists. But I find her to be incredibly judgmental...
and unwilling to be flexible with change either in tasks or her mindset. It's her
way or the highway, I had proposed some very needed changes which she shot
down... closed minded people are - vulgar.

Please be sure to be wearing rose-tinted reading glasses when you read the testimony by LACCC Director Marcia Mayeda so you can see it in the same light as the Supervisors, who swallow everything she tells them purely for the purpose of expediency.

Why is it in the blinkered eyes of the BOS that everything Marcia Mayeda says is true, while everything her critics says is not true? Isn't it commonsense that that's the case?

ps: Can government officials be prosecuted for perjury? I hope so. It's a pity they can't be prosecuted for wearing blinkers, which is what the BOS is doing here.

BUT WHEN THE NEED ARISES, WE CAN PULL OUR RESOURCES TOGETHER AND HELP THE ANIMALS.

IF WE COULD GET IT OUT, WE WOULD TAKE IT TO A VET OF OUR OWN AND CARE FOR THE ANIMAL. BUT IT WAS BEING HANDLED UNTIL HE WOULDN'T LET US IN THERE ANYMORE. AND THAT'S WHEN ANIMAL CONTROL STEPPED IN AND GAVE HIM NOTICES TO COMPLY. HE PANICKED WHEN IT WAS GETTING DOWN TO THE WIRE AND ASKED ME IF I WOULD STEP IN AND TAKE OVER OWNERSHIP OF THE ANIMALS, WHICH I DID, SPEAKING WITH MARCIA AND SPEAKING WITH RACHEL, SO THAT THEY WOULDN'T ALL GO INTO ANIMAL CONTROL. BUT WE ACTUALLY GOT THE NUMBERS DOWN TO PROBABLY JUST UNDER 200. SO WE ADOPTED OUT QUITE A FEW ANIMALS THIS YEAR. AND WE DID THAT WITH THE CONTROL AND HELP OF ANIMAL CONTROL. WE WOULD CHECK IN EVERY WEEK AND LET THEM KNOW HOW MANY ANIMALS WE'D PLACED SO THAT SHE COULD GO IN AND DO A COUNT SO THAT WE COULD KEEP A CONTROL, VERY, VERY TIGHT CONTROL OVER HIM. SO I JUST WANTED TO COMMENT THAT WE DID WORK VERY CLOSELY WITH HIM. WE DID A GREAT JOB AS FAR AS GETTING THE NUMBERS DOWN SO THAT THE DEPARTMENT WASN'T GOING TO BE STUCK WITH OVER 300 ANIMALS.

The fact is that LACCC did not prosecute Ivan in the 2004 hoarding case in Gorman. That's because the investigator they assigned made a hash of it, and never even wrote a report to submit to the DA's office.

Another fact is that LACCC went about this all the wrong way. They could have involved the coalition of rescuers who are now helping get everything in order much earlier, and worked with them to get the animals off the property, then busted Ivan.

Working with a single rescuer--especially that rescuer--was never going to work.

As for the dogs dying in the Lancaster shelter: thousands die there every years. Nobody is stopping that.

we rescuers are SO quick to judge... and judge in a harsh light
criticize and lay blame... she should have done this and that...
each person has to wrestle with own conscience at the end of the day
and we need to just do the best we can...

hey BEFORE alex was busted I tried to do something to help the situation...
Other people saw the signs... and yet... who took the blame... alex...

we KNOW when a rescuer is in over their head... when they agree to take
pretty much any animal... we KNOW the signs...

but we continue to dump and just say to ourselves... how can they always
keep saying yes and even though they are saying they are FULL they keep taking
them... make room for one more... one more...

the PROBLEM is WE rescuers need to accept some culpability here as well
I would BET that others knew what was going on and did NOT step up

but now afterwards we are so willing to point the finger...

would you take on the task of dealing with 300 animals...

so maybe the shelter did not find this rescuer... but maybe they found each other

I also tried to do something to help the Bemis dogs and got no where with the shelter...
all i asked for was a list of the animals and where they were... and saw that task
would be immense...

not something I want to handle nor do I have time to handle it...

the problem IS... that everyONE is overwhelmed... and not until it hits the spotlight
that rescuers are first to jump in unfortunately it is not to help but first to JUDGE...

and I have no idea the details of this situation...
but has scott of rescue alliance stepped in to offer help...

somehow i would doubt if Toni would decline help from either of them...
However I would completely understand if she declined help from those
who would judge her... who needs that headache... thats the too many cooks

Why does LA have so many non profit animal rescue groups...???
because NO ONE agrees on much in rescue... everyone wants to be
their own boss...

unless you were Toni's shadow from day one... no one really knows
truly what is happening... its all speculation and hearsay.

I am just saying it helps less to pass judgment and it helps more to roll up your sleeves

I would love to see less accusations between rescuers
and more REAL help and support of each other...
