By
submitting a photograph (“Photograph”) in any format,
including but not limited to print, electronic or other, I (“Entrant”)
hereby warrant that I am the sole owner of such Photograph, or
have the express authority of the applicable owner(s) to submit
said Photograph to BreakinThru Films (“Company”).
Further, any submission by Entrant shall automatically grant Company
a royalty-free, irrevocable, worldwide, non-transferable, non-exclusive
right and license to use and display such Photograph in the manner
of Company’s choosing, in whole or in part for a period
of twenty (20) years from the date of submission (“Licensing
Period”). Entrant further warrants to Company that any Photograph
submitted shall not:
1. contain material that is copyrighted, unless Entrant owns the
copyright or has the permission of the copyright owner to license
the material;
2. infringe upon any intellectual property of others or their
privacy or publicity rights; or
3. attempt to impersonate another person, or in any way includes
references to another person or entity, other than the subject
matter requested by Company.
Entrant shall indemnify and hold harmless Company from any claims
arising due to any breach of the above-agreed upon terms.
